Thank you Mr. Hubbard on helping to clarify Frederick's position. Frederick had left his unit the 15th Lt. Artillery earlier in the day to go look for additional ammunition since his unit was running out quickly. The first two places he went to were out and this is when he started back towards his unit. He would not have known at all that Col. Miles was getting ready to surrender, since he was out in the field. He was under a standing order to find ordance for his unit. He came upon the unit in which the comanding officer had left on horse back because of the intense firing. This to me sounds like the officer was a coward plus telling his men to lay in the gully and not to fire back towards the enemy. What did Frederick do when seeing an artillery piece not firing, he asked for volunteers to return the fire. His commrades on other points on Maryland Heights and Loudon Heights were still firing and taking fire. He and the men of that until got artillery working and firing. I have seen the maps of the area and it would have been IMPOSSIBILE to have known that a cease fire (white flag raised) from his position, plus no one knew that he was even the one firing the weapon. It was only known after the fact.
